1. Introduction:

Some neighboring countries have developed a text or set of laws known as the "Status of the Artist" or "Statute of the Creator" who come to regulate the social, business, tax and, sometimes, copyright of artistas de todas las ramas de la creación. Los ámbitos de actuación de este tipo de documentos o normativas pueden ser: – Trato fiscal del artista y de su obra – Adscripción al sistema de Seguridad Social – Derechos de Autor – Contratación y Buenas Prácticas Profesionales – Arbitraje – Formación reglada y continua. Algunos de estos capítulos presentan problemáticas especialmente acuciantes para la mayoría de los artistas visuales españoles que reclaman la intervención de nuestras asociaciones para conseguir cambios en la legislación y mejoras en el trato profesional. Pero la capacidad o competencia legislativa sobre buena parte de estos ámbitos en nuestro país corresponde al Estado en exclusiva y nada o muy poco pueden hacer las Comunidades Autónomas. La Unión de Asociaciones de Artistas Visuales es el instrumento que hemos creado las asociaciones autonómicas para afrontar los problemas cuyo marco de resolución es estatal o europeo. De manera que la UAAV tiene ante si el deber y la responsabilidad de afrontar esta problemática. De la misma manera, no hay que perder de vista que en general los “Estatutos del Artista” no se ocupan –solamente- del artista visual. Incluyen a los dos grandes grupos de artistas o creadores en general: los que trabajan de manera autónoma (profesionales) y los que trabajan a cuenta de terceros (asalariados), que requieren tratos fiscales y de adscripción al sistema de Seguridad Social distintos, incluyendo, finalmente, aspectos troncales o comunes. Los “Estatutos” afectan, por tanto, a los artistas de las artes escénicas (teatro, danza, música, circo), literarias, visuales, etc. Finalmente, algunos de los aspectos tratados pueden o deben de abordarse desde la perspectiva europea. La modificación de determinados impuestos (IVA, por ejemplo) o de propiedad intelectual requieren un acuerdo en el marco de la Unión Europea. Se da la circunstancia de que la propuesta de elaborar un “Estatuto del Creador” figura en el programa electoral del PSOE con el que concurrió a las elecciones del pasado 9 de marzo. Antecedentes (más próximos) en las artes visuales y proyectos en curso La misma UAAV y algunas de las asociaciones que la integran ya cuentan con experiencias y documentación interesante sobre este asunto. Hay abundante material sobre la Ley de Propiedad Intelectual y propuestas de reforma parcial (fondo documental de VEGAP y la Fundación Arte y Derecho), el “Manual de Arte y Legislación, UAAV, Madrid 2002” y el más reciente “Manual de Buenas Prácticas Profesionales en las Artes Visuales, Madrid 2008”. Las conclusiones de las Jornadas de debate Posiciones II, “La condición europea del artista visual”, UAAV y EVAN. Palma de Mallorca, diciembre de 2003. La UAAV ha realizado un encargo de estudio sobre el “Estatuto del Artista” a sus asesores jurídicos Brun y Guiu Advocats, financiado por el convenio de colaboración FAD-UAAV 2008. AICAV, con el apoyo de la UAAV, presentó una serie de medidas para modificar el trato aduanero de la obra de arte entre la Islas Canarias la península y la Unión Europea. La asociación de Catalunya ha formado parte de un grupo de trabajo –con los creadores de otras disciplinas- que ha concluido con el Informe sobre el “Estatut de l'Artista”, del bufet Bergos & Associats por encargo del Departament de Cultura i Mitjans de Comunicació de la Generalitat de Catalunya. 2007. La AVAM acaba de organizar las Jornadas “La profesionalización del artista” (17, 18 y 19 de noviembre de 2008) cuyas conclusiones concretaron diversas propuestas de reformas y cambios.. La Unión participará en la Convención organizada por la Maison des Artistes, (París 15 y 16 de diciembre de 2008) que abordará los aspectos cruciales de la problemática profesional de los artistas visuales a escala europea.

Una nueva manera de gestionar los recursos públicos en materia de Cultura: Un Consejo Estatal de las Artes Descargar

Tres décadas de democracia en España han transformado muy positivamente la Administración pública de la Cultura. A la descentralización del Estado con la recuperación de los Gobiernos Autónomos de las nacionalidades históricas y la creación de las nuevas administraciones en las restantes comunidades, hay que añadir la labor de los ayuntamientos. En este país nunca la cultura y el arte habían gozado de un apoyo y unos medios para su fomento, difusión y proyección como los que dispone en la actualidad. No obstante, esa realidad incuestionable se ve oscurecida por tensiones y dinámicas que deberían de superarse en aras de . El arte y la cultura -como los medios públicos de comunicación- necesitan, por una elemental regla de respeto escrupuloso de la democracia, de una autonomía que impida su utilización partidista por parte de los poderes públicos. La fina línea que separa la cultura o la información de la propaganda política se ha roto demasiadas veces –últimamente de manera alarmante- como para que miremos al otro lado. El actual modelo de administración pública de la Cultura está en crisis. A nuestro entender hay que revisar el sistema, aprender de las mejores experiencias de nuestro entorno y diseñar una nueva forma de administrar los recursos públicos y las competencias en el ámbito de la creación artística que traslade la toma de decisiones a la sociedad civil: un Consejo Estatal de las Artes La Unión de Asociaciones de Artistas Visuales apunta a continuación las características fundamentales del Consejo Estatal de las Artes: Primera. El Consejo Estatal de las Artes no será un nuevo organismo asesor o consultor, dispondrá de poderes ejecutivos en materia de creación artística y autonomía para determinar sus propias políticas, sus propias prioridades y los presupuestos de sus programas y actividades Segunda. El Consejo Estatal de las Artes estará formado por expertos, profesionales independientes y reconocidos por sus creaciones y su servicio en el campo de las artes, la cultura y las ciencias humanas. El Consejo Estatal de las Artes se someterá, en todo momento, a la autoridad del Congreso de los Diputados que celebrará un debate anual sobre el estado de la cultura durante el cual evaluará los resultados de su gestión. La puesta en marcha de este nuevo modelo de gestión de la creación artística exigirá la redacción y aprobación, por parte de las cámaras legislativas, de una Ley del Consejo Estatal de las Artes. 2010 Budget Amendments

Amendments to the State Budget Ministry of Culture.

2. 4. 6. In order to stimulate collecting contemporary art, artists have spoken for the proposal to establish a cultural VAT 4% which would mean the lowering of the art work by 12%. Proposal A: Conduct a study on the impact of VAT reduction in the contemporary art market. Proposal B: Compose a draft European directive on VAT harmonization in contemporary art.

7. Towards an ascription of the artist in the Social Security system

A detailed analysis of the assignment of visual artists to the public social security system in European countries reveals the different levels of social protection. Germany, Holland and France stand by ample provisions on sick leave or unemployment as well as an efficient attachment and a very affordable artist's financial contribution to the financing of Social Security. This framework are contrasted with the Spanish situation in which the artists have to meet high prices by the Conditions of Self-Employed, obtaining in return a very poor performance, no sick leave benefits and a very small pensions. The UAAV poses a social security system that takes into account the payment of fees in proportion to income or access to social protection of artists who demonstrate a clear inability to meet their economic contributions. We propose the disappearance of the duplicity of contributions by those artists who combine their artistic self-sale of their works-in other salaried occupations (teaching, etc..). Proposal: Formation of an interministerial committee with Labour and Social Affairs, Culture and UAAV.

8. Arts and Education (Structural Deficit) The visual expression in his practice, theory and recent history has incorporated with determination and ambition at all levels of the education system through a cross-cutting approach that exceeds the current division credits or subjects and infused into the contemporary knowledge. It is necessary to promote a thorough reform of education in terms of visual expression that meets the training of teachers, nursery school, primary, secondary, high school and college with well-trained teachers with the necessary financial resources.
Proposal A:
commissioned a study on the inclusion of art practice and contemporary history at all levels of education: primary, secondary, and higher arts education.
Proposal B:

establishment of an interministerial committee with Education, Culture, teachers and UAAV.

9. Arts and media (structural deficit) Contemporary art has to be present in the media and public ownership in a special way in the normal hours of television audience. The UAAV offers a quality and reliable information on culture and contemporary art in the media through news programs, dissemination and debate showing contemporary creation and deepen it.
Proposal A:
organize a meeting with the leaders of RTVE and FORTA, Ministry of Culture and UAAV.
Proposal B:
Plan dissemination of art in the media in public ownership.

10. A new way to manage public resources in the field of Culture: A State Arts Council. These twenty-five years of democracy in Spain have positively transformed the public administration of culture. A decentralization of the state with the recovery of the autonomous governments of the historic nationalities and the creation of the new administrations in other communities, we must add the work of municipalities. In this country ever culture and arts had enjoyed support and means for its promotion, distribution and projection as those currently available. However, the undeniable reality is clouded by tensions and dynamics that should be overcome in order to. Art and culture-as the public media, need for an elementary rule of strict respect for democracy, autonomy party that prevents its use by the public authorities. The fine line between information culture or political propaganda has broken too many times, lately at an alarming rate, as we look to the other side. The current model of public administration of culture is in crisis. To our knowledge we must review the system, learn from the best experiences of our environment and devise a new way to manage public resources and expertise in the field of artistic creation that moves decision making to civil society: a Council State Arts Associations Union of Visual Artists points below the key features of the State Council on the Arts: First. The State Arts Council will not be a new advisory body or consultant, you have executive powers in the field of artistic creation and autonomy to determine their own policies, its own priorities and budgets for its programs and activities II. The State Arts Council will be composed of experts, independent professionals and recognized for their creations and their service in the field of arts, culture and the humanities. Its members will be chosen by the Congress of Deputies a proposal from the social partners and professional organizations representing the various sectors of creation. The composition of the State Arts Council is renewed every four years and half of the parliamentary term. Third. The State Arts Council will include representatives of cultural administration of the Autonomous Regions and / or the Arts Council regional level that could be created, in order to foster cooperation and collaboration and outreach programs to determine the international artistic creation made in Spain. Fourth. The State Arts Council will be submitted at any time, the authority of the Congress of Deputies to hold an annual debate on the state of culture during which evaluate the results of its management.
